These Terms of Service ("Terms") govern your use of internet and related services provided by ROAMR LLC ("ROAMR", "we", "us", or "our"). By subscribing to or using our services, you agree to these Terms.

1. Service Agreement

1.1 Service Provision: ROAMR provides internet connectivity and related services on a month-to-month basis unless otherwise specified in writing. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time.

1.2 Service Availability: While we strive for 100% uptime, internet service may be interrupted due to maintenance, equipment failure, weather, or circumstances beyond our control. ROAMR does not guarantee uninterrupted service.

1.3 Service Speeds: Advertised speeds represent maximum capabilities. Actual speeds may vary based on network conditions, equipment, location, and other factors.

2. Customer Obligations

2.1 Acceptable Use: You agree to use ROAMR services in compliance with all applicable laws and our Acceptable Use Policy. Prohibited activities include but are not limited to illegal file sharing, hacking, spamming, or any activity that compromises network security.

2.2 Account Security: You are responsible for maintaining the security of your account credentials and all activities under your account.

2.3 Equipment Care: ROAMR-provided equipment remains our property. You agree to use reasonable care with all equipment and return it in good condition upon service termination.

3. Billing and Payment

3.1 Monthly Charges: Service fees are billed monthly in advance. Payment is due on the date specified in your billing statement.

3.2 Late Payments: Accounts not paid within 15 days of the due date may be subject to service suspension. A reconnection fee may apply for service restoration.

3.3 Price Changes: ROAMR reserves the right to modify pricing with 30 days advance notice to customers.

3.4 Installation Fees: Installation and activation fees, if applicable, will be disclosed prior to service activation.

4. Term and Termination

4.1 Service Term: Residential services are provided month-to-month unless you have signed a specific term agreement.

4.2 Cancellation by Customer: You may cancel service at any time by contacting ROAMR. Cancellation becomes effective at the end of your current billing cycle. No refunds for partial months unless within the 30-day money-back guarantee period.

4.3 Termination by ROAMR: We reserve the right to suspend or terminate service for violation of these Terms, non-payment, or illegal activity.

4.4 Equipment Return: All ROAMR-owned equipment must be returned within 30 days of service termination. Failure to return equipment may result in replacement charges.

5. 30-Day Money-Back Guarantee

New residential customers may cancel within 30 days of installation for a full refund of service fees paid. Equipment will be removed at no charge. This guarantee does not apply to business accounts or custom installations.

6. Limitation of Liability

6.1 Service Interruptions: ROAMR is not liable for damages resulting from service interruptions, delays, or failures.

6.2 Maximum Liability: Our total liability to you for any claims related to our services is limited to the amount you paid for service in the preceding month.

6.3 Third-Party Content: ROAMR is not responsible for content accessed through our network or actions taken by third parties.

7. Privacy and Data

Your use of ROAMR services is subject to our Privacy Policy, which is incorporated into these Terms by reference. We collect and use data as described in our Privacy Policy.

8. Network Management

ROAMR employs reasonable network management practices to ensure network security, reliability, and quality of service for all customers. We do not throttle based on content but may manage traffic during periods of congestion.

9. Modifications to Terms

ROAMR may modify these Terms at any time. Material changes will be communicated via email or portal notification at least 30 days before taking effect. Continued use of services after changes constitutes acceptance of modified Terms.

10. Dispute Resolution

10.1 Governing Law: These Terms are governed by the laws of the State of Florida.

10.2 Informal Resolution: Before filing any legal action, you agree to attempt to resolve disputes by contacting our customer service at support@roamr.io or 888-727-6267.

10.3 Venue: Any legal proceedings shall be conducted in Gilchrist County, Florida or the nearest federal court with jurisdiction.

11. Warranties and Disclaimers

ROAMR services are provided "as is" without warranties of any kind, express or implied. We do not warrant that services will be error-free, secure, or uninterrupted.

12. Miscellaneous

12.1 Entire Agreement: These Terms, along with our Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and ROAMR.

12.2 Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

12.3 No Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
